I would guess that the data just hasn't been flushed to disk. try doing
"killall -HUP rsyslogd" to have rsyslog flush and close all output files
and see if you still have any empty ones.

Rsyslog won't create the file until it has a message to write into the
file, so it's seeing the message and going into the file write routine, so
the only reason you wouldn't see any content in the file is if it's being
buffered.
